Landowners and Participation in PUC Cases

Several West Texas landowners are facing the possibility of a transmission line being on or near their properties because of the construction of the Permian Basin Reliability Projects. The Public Utility Commission of Texas (PUCT) provides a brochure with information for landowners affected by proposed transmission lines and explains the PUCT’s evaluation process and how landowners can participate. ​

Key points include:

  • PUC Evaluation Process: The PUC considers factors like service adequacy, environmental impact, community values, and cost-effectiveness when deciding whether to approve a transmission line and its route. ​
  • Landowner Participation: Landowners can file informal protests or formally intervene to provide input. Formal​ intervention requires following procedural rules and may involve hiring an attorney. ​
  • Stages of a Case: Cases may involve hearings, discovery, and recommendations by an administrative law judge (ALJ). ​ The PUC makes the final decision, which can be appealed in court.
  • Property Rights: Utilities must obtain easements to use private property, either through negotiation or eminent domain. ​ Local courts handle easement disputes, not the PUC. ​
  • More Information: Landowners can access case documents online or contact the PUC for guidance on the process, though the PUC does not provide legal advice.
