On September 9th, Oncor filed its response to the Commission Staff’s recommendation on the sufficiency of its application and notice in Docket No. 37232, Oncor’s application for a proposed 138 kV transmission line in Collin County. In its filing, Staff recommended that the application be found deficient because it did not provide sufficient detail regarding parks and recreational areas within 1,000 feet of the proposed transmission line. Staff also identified several inaccuracies in the notice and a lack of detail associated with certain aspects of the notice.
Oncor says that it discussed the parks issue with the Staff and subsequently identified two small parks that were not previously identified in the environmental assessment (EA). As part of its supplemental response to Question No. 25, Oncor will be including supplements to the EA and will consider the supplemental response to be “part and parcel to the Application.”
Oncor states that it does not believe the issues raised by Staff render the notice “materially deficient” but Oncor will supplement the notice to address the issues raised by Staff. A supplemental notice will be sent to affected landowners, counties, municipal authorities, and utilities. Oncor will publish the revised notice one time in the three newspapers in which the original notice was published.
In its response, Oncor agrees to an extension of the intervention deadline for an additional 45 days from the date that the supplemental notice is sent. Oncor states that it will be sending the supplemental notice on or before September 18, 2009. The administrative law judge will have to approve the new proposed intervention deadline.
