Commission Staff filed on September 4th its recommendation in Docket No. 37232 on the sufficiency of the application and notice and addressed other procedural matters. The recommendation identified one deficiency in the application and eight deficiencies in Oncor’s notices to landowners.
The application was found to be materially deficient in that it failed to provide a complete list of all parks, recreational areas owned by a governmental body or an organized group, club, or church located within 1.000 feet of the center line of the project. The Staff analyst recommended that Oncor’s submitted list contain a general description of each area and its distance from the center line, for all proposed routes, as required by Question 25 in the application.
The Staff analyst identified and described eight deficiencies in the notices and recommended appropriate corrections. The affected links were S (Alternative Route 3), G (Route 38), V V (Alternative Route 62), another description of Route 62, H3, and Alternative Route 38. In addition, the notice makes numerous references to portions of the routes that run “parallel to an apparent property boundary.” The Staff analyst stated that there are no property boundaries shown on the map to support this information.
Staff indicated that it cannot propose an intervention deadline at this time because the notice provided by the applicant was materially deficient.
